Constitutional Assignment

Introduction Interpretation of the Australian Constitution has undergone significant changes throughout Australia's Constitutional history. To highlight the number of different approaches, this paper will critique the method of constitutional interpretation used In Cole v Whitfield (â€Å"Cole†) with reference to the words â€Å"absolutely free† and compare it to the progressive approach in Rowe v Electoral Commissioner (â€Å"Rowe†). For completeness, this paper will outline any other major branches of interpretation not examined in Cole and Rowe.Then, the discussion will focus on the reasons for regressive as the preferred approach for interpreting the Constitution. Cole v Whitfield – Interpretative Method and Critique The High Court used originality in its interpretation of section 92 in its Judgment in Cole v Whitfield . Kirby defines originality as interpreting the constitution by ‘ascertaining what the words meant according to the original inte ntions of the founders'.Mason refer this as internationals (for the purpose of this paper, It will be referred as original Intent In the unanimous decision, the court overruled the view that â€Å"absolutely free† In section 92 of the Constitution protected a personal individual right of freedom In Interstate trade. Rather It means free trade between the states from measures characterized as ‘discriminatory and ‘protectionist. ‘ In aiding its interpretation, the court relied on historical materials to assist in determining the meaning of section 92 and contextual analysis to further validate their claim.To identify meaning of â€Å"absolutely free†, the court broke with tradition by using Convention draft and debate materials to support their reasoning. The high court said: ‘Reference to history may be made†¦ For the purpose of Identifying the contemporary meaning of language used, the subject to which that language was directed and the nat ure and objectives of the movement towards federation from which the compact of the Constitution finally emerged'.From these historical papers, the court looked at the surrounding circumstances leading up to federation to ascertain whether the purpose of the provision was in line with what they were trying to do; and that is to create a federal system that caters for a unified financial framework. From this, the court said the ‘purpose of the section is clear enough†¦ To create free trade amongst the Commonwealth and states like' and there can be no doubt that ass guarantees absolute freedom †¦ Room all interstate border duties Nevertheless, one of the major critiques of original Intent Is the ability to Identify the founders' Intention. To derive a meaning of the words â€Å"absolutely free† from historical materials predominantly relies on certain assumptions that are inherently flawed, namely ; materials are accurate and intention for unforeseen matters and the lack guidelines to source historical materials. The Convention debates are incomplete and inconclusive. More importantly, it does to include assumptions on how the federal system ought to operate within the common law.Griffith CO in Municipal Council of Sydney v The Commonwealth helpfully said of Convention Debates: ‘They are no higher than parliamentary debates, and are not to be referred to except for the purpose of seeing what was the subject-matter of discussion, what was the evil to be remedied, and so forth. ‘ Additionally, the majority in â€Å"Work Choice Case† observed that: ‘To pursue the identification of what is said to be the framers' intention, much more often than not, is to pursue a mirage.It is a mirage because the inquiry assumes that it is both possible and useful to attempt to work out a single collective view about what is now a disputed question of power, but then was not present to the minds of those who contributed to the debates . ‘ Furthermore, if we assume the Convention Debates are complete, there is no evidence to suggest the framers put in what they intended. The Convention Debate would involve different states coming together and agreeing to be regulated under one system of government.In that process, the states would argue the meaning of he provisions, which power they were prepared to give up and the ones they would sustain post federation. The result would at best be a compromise between their interests and subsequently cannot reflect their true intentions. This is evidenced in the Work Choice Case the majority found the Convention Debates reveal very little about what those who framed the Constitution thought would fall within or outside the power'.Even if we were to take it one step further and assume that the framers did expressed what they truly intended, it is near impossible for them to cater for unforeseen matters that arise in an ever changing society. An example is set in Work Choice Case where the court identified that corporations ‘in the economic life of Australia today is radically different from the place they occupied when the framers were considering †¦ Legislative powers†¦ ‘ and that it was impossible to attribute to them some intention about how this legislative power operates in respect of these or other subsequent legal, economic, and social developments'.Lastly, the validity of the historical materials is disputable insofar as the lack of deadlines on how these materials ought to be sourced. There is no clear historical procedure or method in place to ascertain framers' intention. Little comfort can be derived from getting a genuine intended meaning particularly in assessing which of the sources are relevant and which ones are reliable. This is again demonstrated in the Work Choice Case. This is problematic as differences in historical materials may lead to differences in Judicial views. meaning of the section 92 because it dra ws on the idea of a federal system; this impression is reinforced by the context provided by the surrounding provisions, ass-91 deal with fiscal charges and burdens†¦ Appearing in CHI IV of the Constitution which is headed â€Å"Finance and Trade. The court looked at the provision in context to what the purpose of federation and noted that the meaning of â€Å"absolutely free† has not changed, thus concluded that freedom is to mean free from discriminatory burdens in the protectionist sense between interstate trade and commerce .A major limit in making implications via contextual interpretation is that critique will say that it does not stay true to the text of the constitution. In response o this, it is maintained that the text of the constitution only takes on meaning when it is viewed in the context of the overarching structure and function of the constitution. ‘ A more detailed discussion on contextual analyses in discussed in Rowe below.Rowe v Electoral Commi ssioner (â€Å"Rowe†) In contrast to Cole whereby the whole court unanimously agreed on its interpretation approach, the Judgment in Rowe v Electoral Commissioner provides a range of different constitutional interpretation methods. The French Court has taken on a progressive approach in interpreting the words ‘directly chosen by the people' in sections 7 and 24 of the Constitution. Accordingly, it was held certain provisions in the Commonwealth Electoral Act 1902 (Act) contravened sections 7 and 24 of the Constitution because the right to vote is democratic and is supported and protected by the constitution .Underpinning their progressivism interpretation of the constitution, the majority Judges relied on the implied meaning from the text of the constitution (contextual approach) based on accepted principles of the Constitution and authority of precedent cases. Progressivism (otherwise known as the â€Å"living tree† institutionalism), believes that the court sho uld construe the Constitution ‘so as to bring it into accord with modern needs and exigencies'.It is understandable why the French court opted for a progressivism approach because the words â€Å"chosen for the people† back in the sass would only mean those who were allowed to vote (this excluded women and Indigenous Australians) . The evolution of Australia's democratic society has significantly changed since 1901 as evidenced by Incitement and Jacobs J] in Mckinley and cited by French CO that the right to vote was subject to he common understanding of the time'.It is of the view of the writer that any other interpretation of methods used here could not possibly embrace the modern view of Australian democracy simply because the framers could not have foreseen how democracy evolved over time. Thus, it is not practical to apply a 1900 federation system to modern day society as evidenced by Dean J in Diaphanous v Herald & Weekly Times Ltd; â€Å"The Constitution must be construed as a â€Å"living force† representing the will and the intentions of all contemporary Australians, both women & men, and not as a lifeless declaration of the will and the intentions of men long since dead. Contextual constitution and the principles it was set up to uphold. ‘ With constitutional principles of representative government , democracy and federalism, firmly embedded into our legal system, the Judges relied on implication from the actual text of the Constitution. Thus, â€Å"chosen by the people† should be interpreted to mean creating a system of representative democracy because it is in the context of the Constitution that is aiming to set up .More precisely, the court viewed those words as an implied right to vote. Whilst Cole v Whitfield used contextual analysis, the difference here is with Cole, the implication was based on the structure of the Constitution and in Rowe, the implication was sought directly from the text and that the meaning accords with accepted principles of interpretation. These two kinds of implication are outlined by Mason C. J. In â€Å"Act's†.The majority Judgment relied on precedent to conclude the legislative curtailment of the right to vote is constitutionally invalid. All the members of the court relied on the test established in Lange v Australian Broadcasting Corporation (â€Å"Lange†) and relied upon in Roach. As stated by the High Court in Lange, the requirement set out in section 7 and 24 'embraces all that is necessary to effectuate the free election of representatives at periodic elections'.All of the Judicial consideration of the term â€Å"directly chosen by the people† supports the view that sections 7 and 24 of the Constitution extend to an implied right to vote and this was substantiated by the authority of McKinley v Commonwealth , Mincing v Western Australia , Lang and Roach. It is important to note here, whilst this court relied on the precedent to aid in TTS interpretation, the court in Cole overruled nearly 88 years of law by reinstating the meaning of ass.The dissenting Judges Haynes J and Hoyden J preferred various versions of originality, which is slightly different to Cole v Whitfield internationalist approach. The former (Haynes J) found the ‘evolution of the concept of â€Å"representative government† could not evolve into a constitutional norm' as there was no text and structure' of it contained in the Constitution and the latter relied on what the words originally mean in the sass; that is, the question is what meaning skilled lawyers and other informed observers considered those words to bear in the sass' .He concluded that although suffrage at federation did not conform to modern values, this is not a reason to ignore what the means and applications of the word ‘chosen by the people' in the federation age were'. Is one of these methods of Interpretation preferable to any other? For the purpose of comple teness, there is another interpretative method that is not discussed above and that is Literalism. Craven describes literalism as interpreting the Constitution by their ordinary – that is their literal meaning.This is evidenced in the Engineers case whereby the court overturns the reserve state powers doctrine and held that the states only have residual power over matters in section 51 of the Constitution. The obvious advantage of literalism is that it is â€Å"objective† in the sense that Judges does not need to use external materials thus promotes certainty. The fundamental flaw in this approach firstly it ignores implications and secondly, the English language is by its very nature is ambiguous ambiguity can be overcome by using historical materials to determine the framers intentions.The critics will argue that intention is difficult to identify and does not cater for the progression of a nation . It is asserted here that originality and intentionality does have a role in constitutional interpretation albeit a small role. Sir Daryl Dawson in his (Intention and the constitution) states that original intent ‘provides a starting point for the determination of individual cases. ‘ Progressivism as defined in Rowe (above) allows the constitution to be interpreted to the needs of a contemporary society.One of the main critic of progressivism is that it is arbitrary even unelected Judges can ultimately state what the contemporary society views is. On a closer examination, this supposition is unfounded. Kirby argues that the constitution itself and the words in it create limits on Judicial interpretation. Furthermore he argues that the common law structure is there with a long history of precedents, which has been Written down.. Expositions been duly recorded.. To make up the great body of common law. That is, the Judges still need to work within the common law system in light of the Judgments that went before them.This is slighted in the Engineers case , whereby Knox q, Isaacs, Rich and Starker J said that the Constitution should be read ‘naturally in the light of the circumstances in which it was made, with knowledge of the combined fabric of the common law, and the statute law which preceded it'. The history, common law and text of the constitution itself represents the various constraints that Judges need to work with and thus, cannot be viewed as arbitrary. Conclusion Coles intentionality method of interpretation has many flaws inherent in its approach and by definition does not cater for our contemporary society.This is in contrast to Rowe which adopted a progressivism approach and interpreted the words contingent upon external factors such as the context of the words in the Constitution as a whole and the underpinning values of the modern system and its structural framework. It is likely that history may set the context for the words of the provision and provide a starting point for constitutional interp retation but progressivism is the preferred approach as it encapsulates the needs of a changing society and ensures the interpretation is current, practical and logical.

Executives, or corporate-level managers, are in charge of many things governing the success of the company as a whole. Among these are developing a strategic vision and business mission, setting objectives, crafting a strategy, implementing and executing a strategy and evaluating the performance of the strategy. Strategies are especially important because of the value-creation process that occurs because of it. Sometimes, though, execution of strategies fail and the question here is â€Å"why? † One possible reason is that the strategies developed by the executives are too broad and do not take into consideration the environment of the firm at the operational level, which is the lowest level and the closest to the markets. One possible way to curb this problem is through a bottom-up approach, wherein the operational-level managers submit their proposed strategies and the corporate-level managers evaluate and approve these, or the top-bottom-top approach, wherein the corporate-level managers forward their suggested strategies to the operational-level managers, who make changes accordingly, and evaluate the said changes before approving the strategy. Supple Supply Chain According to the Merriam-Webster Online Dictionary (2007), the term ‘supple’ means to be able to easily adapt to new circumstances. When we say that a supply chain is ‘supple’, we simply mean that a firm is very flexible in terms of its ability to synchronize its functions and those of its’ suppliers to match the flow of service, information and materials with cutomer demand. A firm’s environment is constantly changing, especially in our day and age with the advent of technology which brings about major changes to the flow of communication. A firm that cannot take advantage of these changes is sure to fail. For example, the Daimler-Chrysler Corporation had a major problem with regards to the delay in production when a certain portion of its parts was just a tiny bit too large or too small; it would have taken ages for changes to be made. Today, however, using a program called ‘Powerway’, which ables the firm to collaborate more easily with their suppliers, the firm can now avoid delays by forseeing the problem and adjusting accordingly before it even occurs (Mayor, 2007). The best strategy a firm can employ to ensure a supple supply chain is to take advantage of the advancing technology, as the Daimler-Chrysler Corporation has done. The new programs developed by the IT industries offer a way for firms to know and understand the production and business processes to allow for quick response to changes in the firm’s market (Mayor, 2007). One thing to understand, though, is that one should not confuse a ‘supple supply chain’ with a ‘responsive supply chain,’ because a responsive supply chain is a strategy of the firm to counter uncertain demand wherein a supple supply chain is a characteristic of the supply chain. The fact that may weigh against Chou is that the contract never had an actual signature on it. Assuming BTT and Chou have a contract, and BTT has breached the contract by not distributing the game, discuss what remedies might or might not apply. Compensatory damages – Chou could recover actual out of pocket which may include the original $25,000 due to BBT not acting in good faith but would also include loss of estimated potential profits. b. Best Practices Essay Historically, minority groups have been ardent supporters of and advocates for high-quality public education. Black efforts to gain systemic equality in educational policies and practices are well known: the battles for equal per-pupil expenditures; teachers’ salaries; length of school terms; expenditures for buildings, facilities, equipment, and books; curricular offerings; and so on. As a result of these efforts and of political and economic changes nationally and internationally, progress has been made with respect to ending legally imposed school segregation, as well as increasing minority participation in schooling for longer periods of time, that is, raising the median years of schooling completed. This paper aims to identify three best practices which assist the educational progress of minorities. Since public school desegregation began in the mid-1960s, urban school improvement is considered to be one of the most contributing factors for the progress of minorities in educational sector. Black educators and their likeminded allies have increasingly taken the lead in urban school improvement. One facet of this movement has been the study of schools that are effectively educating urban poor black children and making recommendations to other schools that want to replicate effective policies and programs. Researchers like Ronald R. Edmonds, George Weber and Daniel U. Levine began by identifying public schools that were effectively teaching black children and pinpointed their common characteristics, namely strong administrative leadership; orderly but flexible atmosphere, conducive to instruction; philosophy that acquiring basic academic skills is the first order of business; climate of high expectations, and continuous monitoring and evaluation of pupil progress with instructional strategies redesigned as needed (Mohanty, 1994). Achievements of urban school improvements were particularly evident in the middle of 1990s, for instance the data indicated significant increase in New York schools where 70 percent or more of the students â€Å"achieved reading scores at or above grade level for three years† (Iram Wahrman, 2003:119). The second important practice contributing to educational progress of minorities is initiation and further development of various improvement projects targeting directly minority students and their teachers. In the beginning of 1990s for instance, Chicago instituted a plan for mastery learning in reading to correct the widespread problem of low reading achievement. The program provided teachers with comprehensive instructional activities, corresponding student learning activities, formative tests for instructional feedback, and corrective instructional activities for those students who failed to master objectives. A criterion referenced testing program served as the basis for instruction, promotion, and administrative monitoring (Bjork et al, 1994). The New Jersey Education Association (NJEA) in 1996 instituted a School Effectiveness Training Program designed to increase student achievement. The results from this program showed lower staff absenteeism, higher participation of staff in instructional decisions, greater involvement of staff in school activities, reduced costs for vandalism, better management, and higher staff and student morale (McNeely, 1985). The final practice, very important in terms of progress performed by minorities in education is giving a preference to private schooling than public. It must be emphasized that during the past two decades it has become increasingly apparent that larger numbers of minority adults are selecting nonpublic schools for their young. In their desire to obtain the best possible education for their young, they choose private schools, including minority independent schools. These parents say they believe private schools provide their children with better basic skills instruction, cultivate higher order thinking skills, have higher academic standards, and prepare their children for college or the work place more successfully. School improvement for them means leaving public schools. As Slaughter and Schneider points out (1986:17) black parents’ choice of private schools is â€Å"less of a rejection of public schooling, and more of an evolution of a new strategy for insuring future levels of sustained and/or upward mobility for the family. † Increased minority departure from public schools, however, may mean that the more supportive, motivated, caring, and accomplished parents and their children (regardless of income) are not involved in the public school system and that the system is the loser in the process (Henig et al. , 1999). From the critical perspective, minority individuals and communities must consider the costs and benefits of education in nonpublic schools compared with education in public schools not only for themselves, but for the nation at large. At the same time, public schools must make more headway in school improvement if they want to retain the traditional support they have long enjoyed from black families. Many minority students can attain standards of excellence if school improvement policies and programs such as those described above are retained, consistently used, refined, and modified. Individual schools will find that their achievement levels and test scores improve, and that many of them can attain local and national norms even if their populations are poor, or black, or Hispanic, or both. These standards can be achieved without excluding any student from an equal opportunity to be educated. Our country still has a long way to go to realize equity in the schoolrooms of our nation. All students need an equal chance to learn, which means providing equity in financing schools and programs; providing competent, caring teachers; retaining proven, compensatory programs and relating curriculum subject matter to coping with real-life situations and problems. Othello by William Shakespeare | Summary and Analysis Othello, is a very known playwright written by the famous writer William Shakespeare. If you are a person who have read many of his works you would know that his writings are based on love, triumph and tragedy also. Just by reading Othello I can tell that the story is about jealously and betrayal of lovers, and someone ends up dead because of the drama involved with it. Unluckily I will not tell of the summary of the playwright, nor tell about or give an simple analysis of the characters involved in the story. I will give you an examination of the racial connections in the playwright Othello, and relate it to the racial prejudices of Jacobean England. I will be honest, when I first read Othello, I did not quite understood how race was placed into the playwright, and why it had anything to do with Othello, because the theme of the story was basically about betrayal and jealously between two lovers who were separated over jealously. When I did research about Othello and racism, and rea d Othello continuously, I slowly began to realize that race did have some kind of involvement into it. Racism seemed to be a big issued in the days of Shakespeare and others. Some writers wrote their stories based on the society they was in and made it quite recognizable in their story, England and other nations had problems with race just as we did in America Othello is a story that made that obvious, Shakespeare puts in different racial stereotypes into the dialogues, giving them to characters like Iago, Roderigo and Branbantio. In the 17th century, People of England attitudes toward non-Europeans like North Africans and others were said to be shaped by policies and stories by travelers. The term moor came from a country that was used to refer to people from North Africa. People of North and West Africa who was living in the Elizabethan England was put out because of their unusual style of dress, behaviors and culture customs. Moors were also talked about and was put in the category of being sexually overactive and being a more jealous people. Queen Elizabeth gave the moors full recognition out of quick niceness for their help in defeating Spain, but unluckily that was quickly turned over fast and she deported the North Africans or Moors because of bad and unusual behavior and the fear of if she let them stay in England than there would end up being an overpopulation of black people and she seemed to definitely not want that. Back in that time period in England blacks were not associated with the slavery tim e period that we all know of, because the slave time period started late in the 17th century. One part in Othello that opened up my eyes and made me realize that race it was an issue, was when they spoke of different cultures like the Turkish culture and the Vietnamese culture. In Othello it stated that the people in Othello had celebrated the destruction of the Turkish force, I realized that there were some kind of cultural division in the playwright Othello. As I went on with my research and read some of the sources that helped me completely understand the issue, I understood that racism was one of the issues in Othello. One of my sources that I read named Shakespeare and Race discussed that some of the racial issues in Othello also probably had something to do with Shakespeare and the society that he was in, not just the racism acted on the Vietnam society in the play Othello. I also learned that the character Othello who was Desdemonas love was an African or an Moor in the story. A moor is once again defined as an member of a nomadic people, who civilization flourished in North Africa between the 8th and the 15th centuries. Othello seemed to be culturally divided and assorted. In order to answer the question and understand why racism was a big topic in Othello and why Shakespeare incorporated it into Othello, I had to dig deep and go back to the history and the real world outside of the playwright Othello. It also appeared to that the story was written during the time of great racial tensions in England. As I went on I discovered that Shakespeare disguised the white and the black people in Othello. He made the white people seem evil and the black people seem as the good ones. It seemed like Shakespeare was trying to make a point, a point of no matter what color a person is, we are all humans. Mainly because this was true, back then, whites seemed to be over people of color, while people of color was so called inferior under white people. Queen Elizabeth also made contributions to racism in England ,this might have stemmed off to racism in Othello. In the book English Ethnicity and Race in Early Modern Drama it stated that When Queen Elizabeth ruled England she exiled ten Africans from her country, then afterwards Queen Elizabeth traded the Africans for the imprisoned English men held in Spain and Portugal.(pg5 English Ethnicity and Race.) . This was similar to what I stated earlier. After the end of Elizabeths ruling Elizabethan England became Jacobean England and was under the rule of King James. Not like his other works, Shakespeare did not reserve the playwright or story of Othello to an earlier time period. Historians also stated that by the time William Shakespeare wrote Othello, England had already been exposed to Africans or blacks. Terri Vaughn an History Professor of Columbia University stated that by the year 1555, there were books in England describing the Africans or as they say the Moors of Africa.(Vaugh n). I also learned from my research that in the sixteenth century the meaning of the color black was defined as deeply stained with dirt or being dirty. Writers such as William Shakespeare and others referred to any dark person from North African as a Moor or a black moor. I also learned that white people or light skinned blacks that was from Africa wasnt considered an moor because they couldnt tell if they was from Africa or not. When I started to read and understand Othello more I realized that Othello was about a relationship between a black man and a white woman. Usually back in the slavery days if a black man was in a relationship with a white woman he would face some kind of punishment for that. It would have been like an offense or an rule that was broken by the black man. Maybe no connections or association with other nations or countries made it to be that way. England people who went outside of their race were viewed as barbarians. those who fell outside the borders of the know n, white world were viewed as â€Å"barbarians, which means a member of a culture thats uncivilized and its sometimes considered offensive. Michael Neil states in an article that was written by him called Race in Literature†. The term moor probably have existed as a description in terms of color, but not necessarily in terms of its position to the white civilized world .Othello is a play with a lot of racial feeling in it.† writes scholar Michael Neill(1985). In the article called Shakespeare and Race, written by John Stows. it greatly emphasizes that to the Elizabethans the appearance and conduct of the moors was a complete outrage, saying that here was a big difference between themselves and the moors. The article also explained that when William Shakespeare chosed an African or an moor as an hero or general, he wasnt really confused or had lack of knowledge bout racial thought or racism, but was more aware of his society who made the divisions of black and white world a big issue. The character named Iago in the story made races remarks about Othello calling him a black ram. Othello is treated unequally in the story because he is black and not white, if Othello was a white man, Im pretty sure he would have been treated fairly with no names and racial slurs called out at him. Comments of racial remarks are said all through out the story. Emilia also made a racial remark toward Othello, She called him an blacker devil, when she found out that he killed Desdemona. There were other characters who were racist towards Othello like Iago, Emilia, Brabinto, and Roderigo. Iago made the racial comment about Othello, because he simply didnt like the fact that he made lieutenant and that he was married to Desdemona. Iago also made a racist comment to Desdemonas Dad about Othello and Desdemona. He states, Even now, very now, an old black ram is tupping your white ewe. Iago had it in for Othello he simply tried to turn every one against Othello, even Desdemonas dad. Many rac ist comments like thick lips was said about Othello. Yet they were very messy because they never said it in his face. It seemed as if Shakespeare wanted race to be known to his readers of his stories, he wanted people to see that there wasnt just whites in the world, there were other races in the world also and that people of other races was good also and people of Caucasian decent made blacks and others look like negative entities. Shakespeare wrote three other plays with non whites and moors in it, They are The Merchant of Venice, Titus Andronicus and of course Othello. Many think that you will find honest straight up racism and racist sayings and language in Othello. It seems like it was just depicting the society of that time. Before we had freedom blacks was considered to be under and lower than whites. But jealousy is more likely to be the theme of Othello. Othello is an historical reading that explores race in other countries and in Literature. It portrayed one of the first love stories of an interracial couple who is destroyed and broken up over hatred and jealous by people who didnt want an accomplished black man to survive and make out in a good situation. Even though William Shakespeare might have lived in an racist place and was surrounded by racist people it showed that he personally wasnt an racist person. Maybe William Shakespeare himself did approve of an relationship of an white woman and black man. The Juvenile Justice system, since its conception over a century ago, has been one at conflict with itself. Originally conceived as a fatherly entity intervening into the lives of the troubled urban youths, it has since been transformed into a rigid and adversarial arena restrained by the demands of personal liberty and due process. The nature of a juvenile's experience within the juvenile justice system has come almost full circle from being treated as an adult, then as an unaccountable child, now almost as an adult once more. Studies and anecdotes have shown that our modern approach, however, is ill-equipped to reduce crime or deal with chronic delinquents while at the same time protecting their due liberties. We now stand on the precipice of decision: How can we strike an appropriate balance in the juvenile justice system? Should we even retain a separate system for children at all? The answers are usually difficult, sometimes subtle, but always possible to attain. This paper will analyze the different theoretical issues pertaining to the modern juvenile court, determine their origin, and suggest a course of action for resolving these issues to the best extent possible. It is important to note, however, that the juvenile justice system alone cannot ever prevent all juvenile crime, respond perfectly to every situation or treat every suspect fairly. Furthermore, an effective antidote to modern juvenile crime would necessitate far broader action, addressing underlying social structure inequalities that breed poverty and social disorganization. The Hawksbill Turtle Eretmochelys imbricata Shane Stoughton GS 108 Oceanography Suzanne Bannan September 05, 2012 INTRODUCTION Sea turtles were making their appearance about 65 million years ago, also the time that dinosaurs were being wiped out. These magnificent creatures did not succumb to extinction like their dinosaur counterparts primarily because they were submerged beneath the ocean when the asteroids struck Earth. This is one of main reasons I chose the specific sea turtle The Hawksbill Turtle. The scientific name of The Hawksbill turtle is eretmochelys imbricata.This sea turtle gets its name from its hooked beak formed by its yellowish jaws. The Hawksbill Turtle is one of nature’s longest surviving creatures. This fact sparks the interest of many people into wanting to learn more about sea turtles. One unfortunate fact of life for this turtle is that they have always been creatures of high demand with their shells prized for their use in jewelry and beads and their b odies for meat. As with other sea turtles, one of the best ways to monitor the status of populations is to survey nesting beaches over many years.However, because hawksbills usually nest in small numbers and often on remote beaches, it is very difficult to estimate the population size. Like many sea turtles, hawksbills are a critically endangered species due mostly to human impact. Hawksbill eggs are still eaten around the world despite the turtle’s international protected status, and they are often killed for their flesh and their stunning shells. (NatGeo 2012) The decline of this species is primarily due to human exploitation for tortoiseshell. While the legal hawksbill shell trade ended when Japan agreed to stop importing shell in 1993, a significant illegal trade continues.Other threats include loss or degradation of nesting habitat from coastal development and beach armoring; disorientation of hatchlings by beachfront lighting; nest predation by native and non-native pre dators; degradation of foraging habitat; marine pollution and debris; watercraft strikes; and incidental take from commercial fishing operations. (FWS 2012) The most important thing that can be done for this species is to make the public aware of their actions that harm the turtles and how they can change their ways. One surprising threat to sea turtles is the balloons that people let go.These balloons often float over the ocean before popping, and sea turtles can choke on the pieces of the balloon that fall into the water. Floating balloons look like jellyfish to sea turtles. Where can we find the Hawksbill Turtle? When it comes to where sea turtles are found, it can vary from very shallow waters, to greater depths of the ocean. Hawksbills are found mainly in the tropical regions of the Atlantic and Pacific Oceans. In the western hemisphere, nests have been reported as far north as Massachusetts, with some being present in the Long Island Sound.However, between the Carolinas and Ne w Jersey, very few Hawksbill Turtles have been sighted, much less recorded. Hawksbill Turtles are also found around the Oceanic Islands, and the Indian Ocean. Hawksbills use different habitats at different stages of their life cycle. It is widely believed that posthatchling hawksbills are pelagic and take shelter in weedlines around convergence zones. Sargassum and floating debris such as styrofoam, tar balls, and plastic bits (all common components of weedlines) are consistently found in the stomachs of youngsters that strand in Texas.It is likely the weedlines in the Gulf of Mexico serve as a habitat for hawksbill that enter the US waters. (Turtles 2005) After the turtle spends some time growing concealed in the weedlines, these are known as pelagic zones, the creature re-emerges back out in the oceanic waters, (oceanic zone) mostly off coastlines when they reach 20-25 cm in length. This is after the turtle has matured quite a bit considering that the turtles average length throug hout the span of its life (30 to 50 years) and can usually reach 2-3 feet (roughly . to 1 meter) in length, which is not particularly large when compared to other species of sea turtles, and weighs anywhere from 100-200 (45-90 kg) pounds. So, long story short, they spend a considerable amount of time on in the weeds of coastlines before they re-enter deeper oceanic zones. Hawksbill turtles are most commonly found in coral reef habitats where sponges, a food source for hawksbills, grow on solid substrate. They also reside in shoals, lagoons of oceanic islands and on continental shelves. MarineBio 2012) In the Caribbean, as hawksbills grow they begin exclusively feeding on only a few types of sponges. However, in the Indo-Pacific, hawksbills continue eating a varied diet that includes sponges, other invertebrates, and algae. The ledges and caves of coral reefs provide shelter for resting hawksbills both during the day and at night. Hawksbills are known to inhabit the same resting spot night after night. Hawksbills are also found around rocky outcrops and high energy shoals, which are also optimum sites for sponge growth.They are also known to inhabit mangrove-fringed bays and estuaries, particularly along the eastern shore of continents where coral reefs are absent. The main threats that are associated with this turtle’s habitat are: habitat loss of coral reef communities, harvest of their eggs and meat aka commercial exploitation, increased commercial as well as recreational use of their prime nesting beaches, and accidental capture in commercial fishing nets. Reproduction, nesting, and migrationMales can be distinguished from females by their longer, thicker tail that extends well beyond the posterior part of the carapace. Mating often occurs at the surface in shallow waters near nesting beaches. Males will use their long heavy claws and tail to hold onto the females carapace. Copulation may last for several hours. (allthesea 2012) After the turtles hav e mated, the female turtles go into a nesting period, at night during the months between May and October the turtles will find a secluded small island somewhere to select a place to lay her eggs.They make sure that when choosing a site in which to lay their eggs that it is some distance away from the high tide line and more often than not choose a site underneath the brush on the island. They then begin to dig a pit about the size of their body with their fore and hind flippers creating a chamber for the eggs. After the turtle has laid all of her eggs, she will then refill the pit with sand covering the newly laid eggs and promptly return back into the ocean.Hawksbills only nest every two to three years but can lay up to six clutches of eggs within one breeding season, which on average lasts anywhere between 14-21 day increments. Females who re-nest often return to the same island where they originally laid their eggs, and it can also be within a few meters of the last nest. Most cl utches average about 130 eggs, but they range anywhere from a few to as many as 230 eggs! The Hawksbill Turtle migrates up to 2400 km between foraging areas and nesting beaches (Miller et al. 1998).The recovery of flipper tags suggests that Hawksbill Turtles are highly migratory, as animals that were tagged in the northern Great Barrier Reef have been recaptured in foraging areas in the southern Gulf of Carpentaria, south-eastern Indonesia and southern Papua New Guinea (Limpus in press, as cited in DEWHA 2008). Individual turtles foraging in the same area do not necessarily take the same migration route (Limpus 1992). Nesting populations in eastern Queensland migrate from the Solomon Islands, Indonesia, Papua New Guinea, and Vanuatu (Miller et al. 1998; Parmenter 1983).Captures of tagged turtles have also shown that individual Hawksbills also move between Papua New Guinea and the Solomon Islands (Vaughan & Spring 1980). Pre Revolutionary War Attitudes

By the 1750’s, Americans began to query their involvement with the British Empire by establishing their own identity and unity as Americans. The colonist began to see a strong display of British oppression. Taxes and the different Acts, such as the Intolerable Acts caused the colonists to believe that it would be better if they were separated from their mother country. Colonists also felt that some of their rights and liberties were being taken away by the British Empire. By the eve of the revolution colonist had a sense of identity of an American.America became the melting pot of the world. Colonist began to think of themselves as a new race of men (Document H). Colonist slowly dismissed their ancient dispositions and demeanor and accommodated new ones (Document H). With a natural barrier (the ocean) between Great Britain and America, colonist started to think of the colonies as a separate nation (Document B). The ocean caused the colonist to believe that they were separated from the mother land for a reason (Document B). They believed that the ocean was there to prevent the colonies from blending with Great Britain (Document B).Since colonists were separated from Great Britain they considered having their own congress (Document D). The colonist would rather have three thousand people who is living near them and who can see the problems they are facing govern them rather than have one person govern them that isn’t there and doesn’t know what’s going on in the area the colonist are located at (Document D). Another act of identity is show in 1774 and 1775 (Document G). During those years Boston wasn’t relying on Great Britain to provide them with donations of goods, such as food, animals, or money (Document G).This illustrates that the colonies don’t need to confide on Great Britain and they can depend on the other colonies alternatively. Throughout these events it is evident that the colonists are displaying a sense of identity. Before the revolution, the colonist displayed many acts of unity. In 1754, a picture of a cut up snake was posted in the Pennsylvania Gazette (Document A). Benjamin Franklin once said, â€Å"If not united to form a whole snake, then the snake cannot survive†. The picture displayed that if the colonies do not come together as one united nation, it is possible that the different colonies could perish (Document A).This picture could have motivated the colonies to act as one nation. In 1774, it was said that a very small corrupted Junto, a self appointed committee in New York acknowledged the idea that all of North America was united (Document C). The Junto also acknowledged that North America was determined to defend their rights and liberties endlessly against Great Britain (Document C). On July 6, 1775, the representatives of the United Colonies of North America met in Congress at Philadelphia to talk about going to war (Document E).Colonists were daring to start reb ellions and resist their authority to preserve their liberties (Document E). The representatives were under the impression that all the colonist had the same state of mind. They thought that they would rather die as freemen rather than like slaves (Document E). Another unifying act of the colonies was when many of the colonies donated food, animals, money, and etc to Boston in 1774 and 1775 (Document G). The colonies donated goods due to the Intolerable Acts, when the British closed the Boston ports.This illustrates that the colonist were willing to come and work together to help other colonies in need. Throughout these events it is evident that the colonists are displaying a sense of unity. Throughout history there has been many acts of Americans developing a sense of identity and unifying as one nation. Americans were very devoted to making sure they were not taken advantage of by Great Britain. Although Americans had to fight for their independence and their liberties they were a ble to push and break free from the British Empire.

Animism

The term â€Å"animism† is defined as the belief of a life-force existing within non-human forms. In other words, according the this idea, non-human forms such as thunder, rocks and trees are possessed by spirits and souls. The term, first developed as â€Å"animismus† by chemist/physicist Georg Ernst Stahl in 1832, defined as the â€Å"doctrine that animal life is produced by an immaterial soul†, was reintroduced in 1871 by English anthropologist Sir Edward Burnett Taylor to be defined as the â€Å"theory of the universal animation of nature†. The mass majority of animistic belief systems holds that the soul within the non-human form will be able to survive physical death. It is believed in some systems that the soul must journey to pass through to an easier world. In other systems, it is said that the soul would remain on earth as a ghost. There are also situations where it would return to earth in order to avenge its death. If murdered, the spirit would either assist in discovering the identity of its murderer or wreak vengeance for itself. A widespread belief of those who die a violent death is that the soul would become a dangerous spirit and endanger the lives of those who approach the haunted area of the its death. In literature, animism is most often used in mythology and folklore. The myths and folklore generally contain a magical or spiritual sense to the story. An example would be of the tale of the Pontianak. The Pontianak is a type of vampire in Malay folklore and Indonesian mythology. It is said that a woman who has died during childbirth becomes undead, seeking revenge and terrorizes villages. The use of animism is applied because the Pontianak is not human and has a spirit within. Many Urarina myths apply animism into their myths by portraying plants, inanimate objects, and animals as personal beings. An example would be of a Urarina deluge-myth, a myth of a great flood sent by a deity to destroy civilization as a punishment. It is said that a man had saved himself from the flood by climbing a tree. The man's wife had transformed into a termites' nest and was clinging onto the tree and their two sons had transformed into birds. Though the man's wife and sons are not in their human bodies anymore, their souls are still intact within their new form. Therefore, this myth applies the use of animism.

What Is Culture

WHAT IS CULTURE? Culture is a word frequently used by people everywhere most times they use it to make a point clear to someone else in the way they see and interpret things. We all practice culture in one way or another even though most people do not notice it. One thing clear to us is that culture is attached to everything we do. Williams and Geertz both portrayed quite similar and different ideas towards culture in their essays. Williams noted that culture is a whole way of life, (pg. 1) this is in the sense that in everything we do we apply culture.The way we talk, eat, worship and so on culture is depicted inside it. For example, in a family it is possible that before they eat they wash their hands and say a prayer; right there a part of culture is shown. Also in a way it shows that culture is ordinary. Culture does not necessarily mean it has to be something of a big event, the tiniest things we do can portray culture. Geertz divided his view of culture into three parts known a s culture theory. He also mentioned that culture is an acted document and also described it to be public.For culture to exist it has to be practised. Geertz made a point by saying culture is an acted document because the name culture is not something we just have to know, we put culture into action and for it to be public means people have to notice it. If a particular group of people have a certain culture they depict it is important that others are aware about it, because that way they can share ideas and appreciate the works of others. This shows that culture is included in everything we do. Williams also included in his essay that culture is like a journey.He used the word like to distinguish the distance between culture and journey. Culture is like a journey in the sense that it continues to grow from generation to generation. Even if the people decide to stop such culture, it will still be in history that they practiced it and history cannot be erased. Again culture is include d in everything we do including the way history is being taught. According to Geertz’s essay he said that, ’Culture has different meanings and is shown in different ways’.In a world filled with over a billion people we do not expect everyone to be exactly the same. We all have our different likes and dislikes, we have different attitudes and we look differently. The same thing applies to culture our way of life does not have to be the same as the person next to us, that is what makes culture interesting and broad. Our culture and the way we see and read meaning to it might not be the same way a stranger sees and interprets it. And for culture to be shown in different ways proves the fact that culture is also a form of being creative.Again culture is attached to everything we do including creativity of the body and mind. Williams described culture in another way he used the teashop as an example of where cultivated people went to. When people use the word uncultu red the first thing that comes to their mind is when someone does something insane or disgusting. In the case of the teashop Williams said he was intimidated by the people that went to the teashop meaning he felt uncultured he did not get why they went there to just sip tea or coffee meanwhile to them it was a normal thing.If people find going to a teashop very intriguing and important as little and unimportant as it may look it shows that they follow a certain style of culture, this is just another idea that culture is attached to everything we do. Geertz said that people should read meaning to culture (pg. 13). When we meet other people with different culture, it is courtesy to understand their culture. We should not start judging them because of the things they do. Most times when they figure out that we appreciate their culture they tend to open up more easily and that is the best way to start a relationship with another.

The majority of Siddhartha’s childhood is spent learning meditation, warrior skills, archery and spiritual disciplines. As a prince, Siddhartha was sheltered from the harshness of life and never went without the physical luxuries of life. However, he was never â€Å"satisfied with the mere enjoyment of fleeting pleasures due to his inquiring and contemplative nature (Knierim, 2009).† One night, Siddhartha leaves his palace and wanders around, coming upon people that are suffering from old age and disease and succumbing to death. This was his first experience with reality and he became determined to do something about it, bringing about an extraordinary change to his life. Lacan was very active in the world of Parisian writers, artists and intellectuals of the time: he was a friend of Andr Breton, Salvador Dal and Pablo Picasso, and attended the mouvement Psych founded by Maryse Choisy. France had not proved the most favourable testing-ground for Freud's theories. In 1907 Freud wrote to Jung of the difficulties the psychoanalytic movement had in making any headway there. He put this down to the national character, observing that 'it has always been hard to import things into France. The difficulty experienced by psychoanalysis was greatly increased by the fact that it was simultaneously perceived as Teutonic and Jewish, and was thus subject both to anti-German and to anti-semitic prejudice which were strong in French intellectual circles. It was in this atmosphere that Jacques Lacan developed his own theoretical system. Given the strength of the prevailing cultural chauvinism it is perhaps not surprising that Lacan should have begun by importing into psychoanalysis concepts which had been formulated in a completely different framework and whose originator neither intended nor imagined that they would eventually be married to the theories of Freud. Ethnic Identity and African Americans Essay Ethnic identity is the sum total of group member feelings about those values, symbols, and common histories that identify them as a distinct group (Smith 1991). Development of ethnic identity is important because it helps one to come to terms with their ethnic membership as a prominent reference group and significant part of an individuals overall identity. Ethnic reference group refers to an individuals psychological relatedness to groups (Smith 1991). These reference groups help adolescents sense, reflect and see things from the point of their ethnic groups in which they actively participate or seek to participate. What is ethnic identity? The establishment of identity is an important, complex task for all adolescents, and is considered a major developmental task for all adolescents. It is particularly complicated for adolescents belonging to ethnic and minority groups. Ethnic identity of the majority group of individuals is constantly validated and reinforced in a positive manner where as the minority group is constantly ridiculed and punished in a negative manner. What does this say for those adolescents who are the minority and not the majority? It is important to study or research ethnic identity because it provides better knowledge to help one understand striving for a sense of unity and connectivenesss in which the self provides meaning for direction and meaning of ethnic identity (Spencer, 1990). It is also important to study or research the differences between these groups due to beliefs and values. Adolescents that are the minority are confronted with their ethnicity at an earlier age then Caucasian adolescents majority and they are constantly aware of ethnic differences, which means it is of greater importance to understand the development of the minority individual. It should lead to different assessments when it comes to ethnic identity. For example, African American adolescents are psychologically compared to Caucasian American adolescence diagnoses, which are sometimes inaccurately assessed. Bronfenberner explains the theoretical perspective such as the ecological perspective by saying, The implications for clinical treatment of African American adolescents, mental health workers must be sensitive to the ecological context of their clients. Mental Health workers must realize that there is no single entity called the black family . The black families compared to the other families established their American family. He suggests that these families vary dramatically in backgrounds, social economic status, values, and degree of acculturation to the norms and values of mainstream America (1990). There are also, significant differences that may exist in preparation of African American adolescent, at the level of rearing family practices and in schools (1990). That is, schools continue to reflect historical values that deal with racial-stereotypes and prejudice and beliefs. At the same time there are families trying to avoid and make light out of such situations. These families and communities continue to show constancy by instilling their own beliefs and values through child rearing which maybe different from Caucasian Americas. Identity and ethnicity as adolescent issues Identity has been defined in many ways. It is the concept used to describe an individuals sense of who he or she is (Dashefsky and Shapiro, 1976). Changes in identity occur throughout the life cycle, however, the changes in identity are usually most notable during adolescence. Integrating a positive sense of ethnic identity into ones overall personal identity is an important task of late adolescence (Steinberg, 1996). Ethnic identity has been defined as the aspect of ones sense of identity concerning ancestry or racial group membership (Steinberg, 1996). Ethnic identity development is an essential human need because it provides a sense of belonging and historical continuity. Ethnic socialization Minority children are confronted with their ethnicity at an earlier age than their majority counterparts (Smith, 1991). Parents can help to speed up the early stages of ethnic identity development by taking an active approach to ethnic socialization. Ethnic socialization, according to Steinberg(1996), refers to the process through which parents teach their children about their ethnicity and about the certain experiences they may have with the broader society. Ethnic socialization consists of three themes: 1) understanding ones own culture, 2) getting along in mainstream society, and 3) dealing with racism (Steinberg, 1996). Possible outcomes of ethnic identity development. There are four ways to deal with ethnicity (Steinberg, 1996): Â ·Assimilationadopting the cultural norms of the majority while rejecting the norms of ones own culture.
